CHANDIGARH: The Punjab and Haryana High Court on Thursday issued bailable warrants of Rs 10,000 against head of civil department, Punjab
Engineering College University of Technology, for not filing an affidavit despite court directions on the petition filed by a student. Justice Permod Kohli directed the head to appear in person before HC on August 18, the next date of hearing, to explain why proceedings for contempt not be initiated against him. HC directed that for appearance in court, he would not be able to claim any TA/DA from his employer. The court directed Chandigarh SSP to ensure execution of warrants or be present in court.
Sekhar Sharma, in his petition, had demanded quashing of a decision of PEC senate whereby a student caught using unfair means during an examination was not promoted to the next semester and also sought directions to PEC authorities to register him for the summer term of 2009 in environment engineering.
In the last hearing, HC had asked PEC to file a reply but on Thursday UT counsel informed the court that head of civil department, while refusing to file an affidavit, had forwarded a letter to PEC director which read, “Since the petitioner has not levelled any personal allegation against me and the issues which are required to be placed before the court are not related to me, the institute may file an affidavit as desired by the court according to bylaws of PEC, under which I am officiating as head of civil engineering.”
